1. About these terms
These Terms govern your use of dynamicleads.co and the services provided by Dynamic Leads (ABN [ABN]) trading as Dynamic Leads. By accessing our website or engaging our services, you agree to these terms.
2. Our services
We provide lead generation, lead reactivation, Google Business Profile optimisation, and related marketing and AI services. Scope, deliverables, fees, and term are set out in a separate proposal or service agreement, which prevails where it conflicts with this page.
3. Eligibility
You must be at least 18 and have authority to enter into these terms, on your own behalf or for a business you represent.
4. Bookings and enquiries
You agree to provide accurate information. Booking a call does not create a binding engagement; it is a chance to discuss whether our services suit you.
5. Fees and payment
Fees are set out in your proposal or agreement. Unless stated otherwise: fees are in Australian dollars; invoices are payable by the due date; we may suspend work where payment is overdue; recurring services continue until cancelled per your agreement.
6. Calculators and estimates
Our calculators, projections and estimates (including revenue and conversion figures) are illustrative only, based on your inputs and general industry assumptions. They are not a promise or guarantee of results. Actual results depend on factors outside our control, including your market, offer, list quality, and execution.
7. No guarantee of results
We bring skill and care to our work, but we do not guarantee specific outcomes such as a particular number of leads, replies, sales, or revenue.
8. Your responsibilities
Provide accurate information and timely access; ensure you have rights to materials, contacts, or data you give us; comply with all laws including marketing, spam, and privacy laws; use our services lawfully.
9. Intellectual property
All website content is owned by us or our licensors. Work we create for you is dealt with in your service agreement. Our tools, systems, templates, and know-how remain our property.
10. Third-party links and platforms
We are not responsible for the content, policies, or practices of third-party platforms our services link to or rely on.
11. Australian Consumer Law
Nothing in these terms excludes any rights you have under the Australian Consumer Law that cannot lawfully be excluded. Where our liability can be limited, it is limited to resupplying the services or paying the cost of resupply.
12. Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential loss, or loss of profits, revenue, data, or goodwill. Our total liability for any claim is limited to the fees you paid in the three months before the claim arose.
13. Indemnity
You indemnify us against claims, losses, or costs arising from your breach of these terms, misuse of our services, or breach of any law, including regarding data or contacts you provide.
14. Confidentiality
Both parties keep each other's confidential information confidential and use it only for the engagement, except where disclosure is required by law.
15. Termination
Either party may end an engagement per the relevant service agreement. We may suspend or terminate access if you breach these terms. Clauses on fees, liability, and IP survive termination.
16. Privacy
We handle personal information per our Privacy Policy, which forms part of these terms.
17. Governing law
These terms are governed by the laws of New South Wales, Australia.
18. Changes to these terms
We may update these terms from time to time. Continued use after a change means you accept the update.
